Former café owner gets building back

The state has decided that the former Cindy’s Family Café building, seized in May, isn’t worth auctioning off for $16,000 in unpaid sales taxes from April through June 2015 and August 2015 through October 2016.
The building at 211 E Main St., appraised at $28,840, has been returned to owner Cindy Taylor with a tax lien that any purchaser would have to pay.
Taylor, who has since moved to Salina, closed the restaurant in January and now is offering it for sale.
May’s seizure was the third time the restaurant had been seized by the state for unpaid sales tax.
“There’s a few people I owe money to, and I’d like to get enough money to pay them,” Taylor said. “I don’t want a lot for it, but I do want to pay my taxes and people I owe.”
Taylor has chronic health problems that she says have left her unable to work.
Rachel Whitten of the Kansas Department of Revenue said the state would consider withholding tax refunds, garnishing wages and bank accounts, and similar efforts to collect the debt.
“Taxpayers at any time can submit a petition for abatement if there is a question as to the validity of the debt or the taxpayer has absolutely no ability now or in the foreseeable future to repay the debt,” Whitten said.
