Concrete supplier sues contractors

A Newton concrete supplier filed a petition Nov. 12 against Cooperative Grain and Supply, Bucklin Builders, and Strongform seeking foreclosure of a mechanic’s lien.

Bucklin Builders, based in Sisseton, South Dakota, and Strongform, based in Deer Creek, Minnesota, were hired to construct a grain storage facility just east of Hillsboro along US-56 for Cooperative Grain and Supply.

The concrete supplier, Builders Concrete and Supply, Newton, on Oct. 19 filed a mechanic’s lien against the property because Bucklin Builders owes them $123,257.49 for materials.

According to Builder’s Concrete’s petition to foreclose on the lien, the money remains unpaid. Builder’s Concrete and Supply seeks judgment against the cooperative, Bucklin Builders, and Strongform for the money owed plus costs and interest, and a court decree that their lien on the real estate is superior to other claims or interests on the property.

Builder’s Concrete and Supply seeks an order that the real estate be sold and the proceeds applied to the debt. After a 12-month period of redemption, a Sheriff’s Deed for the real estate and a writ of assistance should be awarded to Builder’s Concrete, the petition says.

In a second count of the petition, Builder’s Concrete seeks $123,257.49 plus interest and costs from Bucklin Builders.
